Ocado Loyalty Trial
The Ocado Loyalty Trial - 1. These terms and conditions, together with the privacy policy, are applicable to the Ocado trial loyalty programme (the “Ocado Loyalty Trial”) and any participation shall be considered as acceptance.
- 2. All members of the Ocado Loyalty Trial must be resident in the UK and aged 18 years or over.
- 3. Registration to the Ocado Loyalty Trial is by invitation from Ocado, and requires the customer to be opted in to receive marketing communications from Ocado. Ocado may refuse an application for any reason in its sole discretion.
- 4. Members are only entitled to one Ocado Loyalty Trial account each. Ocado reserves the right to refuse, merge or close additional accounts at any time.
- 5. Members must register their personal details and keep Ocado informed of any changes. Ocado cannot be held responsible for any loss of Ocado loyalty points or vouchers incurred as a result of out of date details.
- 6. Members are responsible for ensuring that the spam settings on their mailboxes permit emails from Ocado. Ocado cannot be held responsible for any loss of loyalty points or vouchers incurred as a result of the Member's mailbox being set to reject emails from Ocado.
- 7. Voucher numbers remain the responsibility of the member, as do any security details relating to the account. Ocado cannot be held responsible for any loss arising from the member failing to ensure the safe-keeping of these details.
- 8. Ocado may decline to issue, withdraw or cancel Ocado Loyalty Trial accounts, vouchers and Ocado loyalty points, and / or remove a member from the Ocado Loyalty Trial if at any it reasonably believes that a member has:
- a. abused or attempted to abuse the Ocado Loyalty Trial;
- b. breached or attempted breach of these terms and conditions of the Ocado Loyalty Trial;
- c. committed or attempted to commit theft in relation to Ocado, behaved in an abusive or offensive behaviour towards Ocado staff, or supplied false or misleading information.
- 9. Vouchers can only be used for purchases from Ocado unless otherwise explicitly stated on the voucher.
- 10. The Ocado Loyalty Trial is only for consumer use and cannot be used by business customers.
- 11. Ocado loyalty points and vouchers may only be used by the member who is named and registered on the relevant account and anyone who is resident at the same registered address. Ocado loyalty points and vouchers cannot be transferred, bought, sold or in any way traded, except in accordance with these terms and conditions.
- 12. Members can choose to leave the Ocado Loyalty Trial at any time by clicking the opt out link in their Account Settings on www.ocado.com or by clicking on a link in an email. However, by opting out of the Ocado Loyalty Trial, members will be opting out of all direct marketing by Ocado. By leaving the Loyalty Programme members forfeit the right to any Ocado loyalty points or vouchers already accrued or issued.
- 13. Members who do not have an Ocado Delivery Pass will be awarded one Ocado loyalty point for every £2 spent. Members who have signed up to the Ocado Delivery Pass will be awarded one Ocado loyalty point for every £1 spent. Each Ocado loyalty point equals one penny. For members who have an Ocado Delivery Pass, Ocado Loyalty Points are awarded only on each full £1 spent, so if for example you spend £95.25, Ocado Loyalty Points will be awarded on £95 only. For members who do not have an Ocado Delivery Pass, Ocado Loyalty Points are awarded only on each full £2 spent, so if for example you spend £95.25, Ocado Loyalty Points will be awarded on £94 only.
- 14. Ocado reserves the right to vary the rates at any time in its discretion with reasonable notice to members.
- 15. Members will be prompted to enter their voucher number at checkout in order to redeem their Ocado loyalty points. Any number and denomination of Ocado Loyalty Trial vouchers may be used with each order, and Ocado Loyalty Trial vouchers may be used in conjunction with any other vouchers that are valid for that order.
- 16. Under English law, Ocado loyalty points cannot be awarded for non-qualifying products, including tobacco or tobacco related products, or infant formula milk. The purchase of these excluded products will not contribute towards any minimum spend requirements relating to bonus loyalty points offers. Other products may also be excluded from the scheme at the discretion of Ocado without prior notification.
- 17. Ocado loyalty points will be awarded within 28 days of receipt by Ocado of the member’s payment for each order. Unless Ocado encounters any problems with processing such payments, payment is taken within 48 hours of delivery of each order. Ocado reserves the right to not issue Ocado loyalty points on orders where payment has not been successfully processed within 48 hours of delivery.
- 18. From time to time bonus loyalty point offers may be available which will be notified to members via email. If the member takes up the bonus loyalty point offer, provided the member complies with the terms and conditions set out in the email relating to the bonus loyalty point offer, the relevant bonus loyalty points will be allocated to the member in relation to the first shop for which Ocado receives payment from that member after he/she has taken up the offer. The bonus loyalty points will be awarded within 28 days of receipt by Ocado of the member’s payment. Please note that bonus loyalty points will not be awarded in respect of orders placed prior to the date of the email setting out the bonus loyalty points offer.
- 19. Within 14 days of the end of each three month period starting from 1st October 2011, members will receive a voucher or vouchers by email translating the number of Ocado loyalty points earned during that period into money off vouchers, which will be delivered along with the date by which the voucher must be redeemed.
- 20. The number of Ocado loyalty points contained within a voucher shall be rounded down to the nearest £1 earned by the member during that period. For example, if the member has earned 10,070 points, this translates to £100.70 in voucher value. The member will receive £100 in vouchers and 70p (70 points) will be carried across to the next three month period, and will count towards the number of Ocado loyalty points earned in that period.
- 21. Current Ocado loyalty points balances will be regularly communicated to collectors via email.
- 22. Ocado is entitled to remove Ocado loyalty points at any time if products are returned for any reason and a full or partial refund of the purchase price is given. This also applies to the exchange of products, unless the exchange is for products with an equivalent Ocado loyalty points value.
- 23. Ocado loyalty points awarded at the time of the transaction or vouchers already issued may be removed or cancelled if Ocado determines that the Ocado loyalty points were collected in breach of these terms and conditions or were awarded in error. For the avoidance of doubt, any advice or actions of our staff that is contrary to these terms and conditions will not have the effect of changing these terms and conditions.
- 24. Ocado loyalty points have no value until converted into vouchers at the end of the relevant three month period.
- 25. The value of Ocado Loyalty Trial vouchers awarded by Ocado will be based on the number of Ocado loyalty points that a member has collected by the end of the last day of a three month period.
- 26. Vouchers are valid for a maximum of three months from date of issue and are accompanied by an expiry date, beyond which they cannot be used or reissued. Vouchers that are lost or mislaid may be reissued with the original expiry date, providing they have not previously been redeemed. Additional terms and conditions may be found on the vouchers, which may include, but are not limited to, minimum spend, specific delivery dates or days, or specific qualifying products for which the voucher must be used.
- 27. Neither Ocado loyalty points nor bonus points will be awarded in respect of Ocado vouchers used by members.
- 28. If a delivery charge applies to a member's order, such charge shall not qualify as spend in relation to which Ocado loyalty points or bonus points are awarded.
- 29. Transactions on which Ocado loyalty points are earned or redeemed are subject to all applicable legislation and relevant Ocado terms and conditions (including but not limited to cancellation, returns and limitations of liability).
- 30. The promoter of the Ocado Loyalty Trial is Ocado Limited, Titan Court, 3 Bishops Square, Hatfield Business Park, Hatfield, Hertfordshire AL10 9NE.
- 31. Ocado intends to run the Ocado Loyalty Trial for a period of at least six months, but shall be entitled to withdraw the Ocado Loyalty Trial at its sole discretion at any time upon sending reasonable notice in writing to the members.
- 32. A person who is not a party to these terms and conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these terms and conditions, but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
- 33. These terms and conditions do not affect the Ocado Loyalty Trial members’ Statutory Rights. Calls may be recorded for training purposes.
