Terms and Conditions - Ocado Price Promise
- These terms apply to the Ocado Price Promise and apply in addition to our usual Terms & Conditions.
- The Ocado Price Promise will be open to customers for deliveries made in accordance with our usual Terms & Conditions. Any reference to tesco.com in these terms means tesco.com/groceries only. It does not include Tesco’s in-store prices which may vary from its prices online.
- Your order must include at least one purchase of a Qualifying Product (as defined below) in order to participate in the Ocado Price Promise.
- Products which are included in the Ocado Price Promise are identified on our website with the red £ symbol (“Qualifying Product”). We regularly add additional Qualifying Products to the Ocado Price Promise.
- Qualifying Products are those products stocked by Ocado which are either:
- Branded products where identical branded goods are sold on tesco.com; or
- Ocado Own Brand products, where similar and comparable products can be identified on tesco.com, for which the criteria set out in paragraphs 6 and 7 applies (where applicable).
- For Ocado Own Brand products, since identical products are not available on tesco.com, products are compared on the basis of meeting the same need or intended for the same purpose. In addition, key characteristics of the products are also identified (such as organic, free range, fair trade, diet, low fat etc.) to ensure neither party is given an unfair advantage.
- Again for Ocado Own Brand products, we will always match on the most similar size available. In certain cases (which give neither us or Tesco a competitive advantage), products that have up to a 50% weight/pack size difference are compared by calculating an equivalent price for the different pack size. Therefore, in these cases by applying a conversion factor to a larger product so that it is comparable with a smaller product (or vice versa) we will use, as a basis for the comparison, a notional price for the product not available to purchase at the same weight or size as the Qualifying Product. For example, if Ocado cheddar cheese weighs 480g and is £4 and the comparable product on tesco.com weighs 400g and is £3, the price we would compare to the £4 Ocado price is £3.60, which is the equivalent price for 480g of the comparable cheddar cheese at tesco.com.
- The Ocado Price Promise comparison will include promotions at both Ocado and tesco.com and will include Clubcard prices. It is based on what customers would pay for the Qualifying Products at Ocado checkout against Tesco's prices listed on tesco.com, excluding any delivery charges. For example, if you purchase a 1 litre carton of Tropicana orange juice for £2.30 from Ocado, and it is sold at tesco.com for £2, but it is also on a buy two for £3 offer at tesco.com, we will compare the price paid at Ocado against the single unit price of £2 at tesco.com. If, however, you buy two 1 litre cartons from Ocado, we will compare our £4.60 price with the promotional price of £3 for two cartons at tesco.com.
- Coupons, vouchers or voucher codes (including vouchers issued in accordance with any loyalty scheme) which apply to tesco.com orders are excluded.
- If the total basket of Qualifying Products that you pay for (taking account of any substitutions or missing items) could have been bought more cheaply from tesco.com's listed prices (excluding the promotions outlined in 9 above) on the date you received your order from Ocado then you will qualify for a voucher for the value of the total price difference ("Ocado Price Promise Voucher").
- If any of your shops qualify for an Ocado Price Promise Voucher, we will provide you with an email containing the Ocado Price Promise Voucher. We will seek to send this to you within 72 hours of delivery of your order. If the total price of the Qualifying Products in your Ocado shop is the same or less than it would have been against tesco.com's listed prices, we shall send you an email informing you of how much cheaper this order was.
- In order to receive the Ocado Price Promise Voucher and thereby take advantage of the Ocado Price Promise, your marketing status must be opt-in.
- The maximum Ocado Price Promise Voucher issued will be £10. Your Ocado Price Promise Voucher will be valid for 21 days following receipt of your voucher, unless stated otherwise on the voucher (“Voucher Expiry Date”).
- Ocado Price Promise Vouchers can only be redeemed against orders which are due to be delivered before the Voucher Expiry Date and where the relevant code has been entered when checking out.
- Qualifying Products shall not include any products in the tobacco or vape categories, stage 1 baby formula and postage stamps. Ocado Price Promise Vouchers cannot be redeemed against these products or for the purchase of Ocado gift vouchers and food donations with Ocado.
- Items refunded after delivery will have no impact on the Ocado Price Promise Voucher value and we will not take into account the use of a previous Ocado Price Promise Voucher applied to your shopping in calculating your next Ocado Price Promise Voucher.
- The Ocado Price Promise Voucher cannot be redeemed for cash or credit and may only be used once.
- Ocado Price Promise Vouchers are non-transferable and can only be used on the account the Ocado Price Promise Voucher was issued to.
- Multiple Ocado Price Promise Vouchers may be used in one order.
- We check the prices of the Qualifying Products compared to the identical or comparable product on tesco.com daily.
- If we can no longer find a comparable product on tesco.com the corresponding Qualifying Product will cease to be a Qualifying Product.
- All customers must register their personal details with Ocado and keep Ocado informed of any changes. Ocado cannot be held responsible for any loss of Ocado Price Promise Vouchers as a result of details which are out of date.
- All customers are responsible for ensuring that their spam settings on their mailboxes permit emails from Ocado or that they regularly check their junk mail folder. Ocado cannot be held responsible for any loss of Ocado Price Promise Vouchers as a result of the customer's mailbox being set to reject emails from Ocado.
- Ocado may withdraw, cancel, or decline to issue any Ocado Price Promise Vouchers if it reasonably believes a customer has:
- abused or attempted to abuse the Ocado Price Promise;
- breached or attempted to breach these terms or the Ocado Terms & Conditions; and/or
- committed or attempted to commit theft in relation to Ocado, behaved in an abusive or offensive manner towards Ocado staff, or supplied false or misleading information.
- The Ocado Price Promise is available to all our customers, including our business account holders.
- Transactions in relation to which the Ocado Price Promise Vouchers are used are subject to all applicable legislation and relevant Ocado Terms & Conditions (including but not limited to minimum order requirements, cancellation, returns and limitations of liability).
- Ocado shall be entitled to withdraw or amend the Ocado Price Promise at its sole discretion at any time.
